Patna HC commutes death penalty to life sentence in rape & murder of 7-Yr-old girl


The sentence to undergo capital punishment given to a man convicted of rape and murder of a 7-year-old girl has been reduced by the Patna High Court, taking into account the ‘early age’ of the accused.

The man had been convicted by the Trial Court under various provisions of the Indian Penal Code and Protection of Children from Sexual Offences (POCSO) Act. However, the HC, while upholding the conviction of the accused, has observed that “It is true that in the present case, there were aggravating circumstances, but the early age of the appellant is also required to be noticed.” It further stated that the accused is a first time offender and nothing has been submitted before the Court to prove that he has been involved in any case earlier.

In light of these observations, the Court has reduced the sentence of death penalty to life imprisonment while considering his early age and no previous criminal records. In a similar case adjudicated by the Court last month, it had modified the death penalty awarded to a man accused of rape and murder of a 3-year-old to life imprisonment.

The same Court had also upheld the death sentence given to a 50-year-old man accused of rape and murder of 11-year-old girl which has been recently stayed by the Supreme Court.
